This section describes the terms that apply to our SMS messaging programs. By providing your mobile number on any opt-in form on the Site, by giving verbal consent, or by texting us a keyword we publish, you agree to receive text messages from Tipton Motor Sales d/b/a Tipton Ford Brownsville at the number you provided.
Our SMS program is used to send sales updates, appointment reminders, vehicle availability and order updates, service status, promotional and informational offers, and customer-care follow-ups related to our dealership and the inventory we offer.

Tax, title, license, registration, dealer fees, optional equipment, and government fees are not included unless explicitly stated.
Forms and applications submitted through the Site (including financing applications, contact requests, and trade-in evaluations) do not create a binding contract for sale, lease, financing, or any service. Final terms are subject to credit approval, vehicle availability, and execution of a separate written agreement. Information submitted is used solely to respond to your inquiry and as described in our Privacy Policy.

We do not control and are not responsible for the content, accuracy, privacy practices, or terms of any third-party site or service. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF VEHICLE INFORMATION. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIMAS MOTORS LLC OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Tipton Motor Sales and its affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of any third party.
We may modify these Terms at any time by posting an updated version on the Site. Changes become effective when posted. Your continued use of the Services after a change indicates your acceptance of the modified Terms. Material changes affecting SMS programs will be communicated as required by applicable law and carrier rules.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services that is not subject to arbitration shall be resolved exclusively in the state or federal courts located in Cameron County, Texas, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
